Robert Wyrosdick accused Morgan & Morgan of settling his 2023 collision case for $45,000 without his permission. Wyrosdick says he hopes his $4.3 million win will prompt Morgan & Morgan to treat clients better. Wyrosdick’s award was issued by arbitrator Erika Birg, who granted his claims of legal malpractice, breach of contract, and breach of fiduciary duty against Morgan & Morgan and Wyrosdick’s former lawyer, Corey Aitken.
After being rear-ended by a box truck in March 2023, Wyrosdick hired Morgan & Morgan to file a lawsuit against the truck driver and their employer. The lawsuit was filed in Gwinnett County State Court in July 2023 and was initially assessed by the firm as potentially worth $250,000, based in part on the defendants’ commercial insurance coverage.
Wyrosdick said he spoke only once to his attorney, Corey Aitken, early in the case and subsequently to a paralegal before the case was settled, without his knowledge or permission, for $45,000 in 2024. Wyrosdick maintains he received little information or communication from Morgan & Morgan. His case against the Florida-headquartered law firm alleged that its lawyers are overloaded with cases which are predominantly handled by non-attorney staff who have inadequate training. He claimed the firm’s lawyers are incentivized to settle cases quickly at high volume to collect commissions.
